1. Acceptance of Terms
By accessing or using MakeTheQueue ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
MakeTheQueue is a cloud-based queue management platform that allows businesses to manage walk-ins, waitlists, appointments, and customer notifications. The Service is provided by NolaByte LLC.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.
4. Acceptable Use
You agree not to use the Service for any unlawful purpose, send spam or unsolicited messages through our SMS features, attempt to access other users' accounts or data, interfere with the operation of the Service, or resell or redistribute the Service without authorization.
5. Pricing and Payment
Paid plans are billed monthly or annually, depending on the billing cycle you choose. Prices are listed on our pricing page and may change with 30 days' notice. All payments are processed through Stripe. Refunds are handled on a case-by-case basis.
6. Free Trial
New accounts receive a free trial of paid features for the trial period offered at signup. No credit card is required. At the end of the trial, you may upgrade to a paid plan or continue on the free plan.
7. Data Ownership
You own your data. We do not claim ownership of any content you create or customer data you collect through the Service. You grant us a limited license to process your data solely to provide the Service.
8. Service Availability
We strive for high availability but do not guarantee 100% uptime. We are not liable for any downtime, data loss, or service interruptions. We will make reasonable efforts to notify you of planned maintenance.
9. Termination
You may cancel your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be retained for 30 days before deletion, during which you may request an export.
10. Limitation of Liability
MakeTheQueue and NolaByte LLC are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.
11. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These terms are governed by the laws of the State of Louisiana, United States, without regard to conflict of law principles.
